    Ask us: MFDs who run sole proprietorships will have to obtain NISM certificate before the date of expiry of their ARN.

    Since AMFI has asked all sole proprietors to necessarily obtain NISM certification, what if a sole proprietor is not in a position to appear for exam due to age, health conditions and so on?

    Dear MFD,

    In March 2022, AMFI has asked all sole proprietorship ARN holders to clear ‘NISM Series V-A Mutual Fund Distribution Certification Examination and obtain a fresh EUIN in sole proprietor’s name. This EUIN has to be mapped against the ARN of their sole proprietorship to continue distribution business by September 1, 2022 or the date of expiry of ARN, whichever is later.

    So far, MFDs having sole proprietorship model could map EUIN of some other person or employee to the ARN of sole proprietorship. Basically, it was not mandatory for sole proprietors to clear NISM as they can ask employee or partner to do it for them. However this is no longer allowed.

    AMFI has identified over 500 sole proprietors who do not have NISM certification and over 50 HUFs registered under proprietorship category despite the fact that HUF is a separate category. While sole proprietors will have to obtain NISM certification urgently, HUF can continue to work with the current requirement i.e. having one person/employee with NISM certification. However, HUF will have to pay ARN fee applicable to HUF and change its status.

    To answer your question, while AMFI norms clearly say that your sole proprietor will have to obtain NISM certificate to continue business, you may write to AMFI to seek exemption on age or medical grounds. The power to give exemption is with AMFI ARN Committee.

    This is a stupid policy. Nowhere in this world one is asked to acquire the same qualification again & again. With the continuation of MFD business, one acquires more experience & confidence. I have practical experience of stock market of over 35 years. God only knows how NISM certification time & again could be of any use to me. Either you take tough entrance exam or take one time exam fee like Road-tax.

    I obtained ARN in 2003, but due my critical illness my my ARN expired in November 2015, now I renewed my old ARN-9869 in June 2022, my ARN validity from 13-06-2022 to 01-06-2025.
    But my old AUM is above 2.5 crore, but AMC denies my trail commission, I request you to please help me, I required money for my treatment.please help me

    As per old circular, if gap between old and new arm validity is more than 6 months then old aum will be forfeited for brokerages.
    Now the period has been revised from 6 month to 3 month.

    I got my Individual ARN converted to sole Proprietorship in Jan 2022. As a result, the name changed to Sole Prop., but ARN number remained the same as earlier i.e. ARN-35735. My EUIN also remained the same i.e E-048596, which is in my personal name i.e. Manish Saluja. Now my question is : do I need to appear for NISM exam and take EUIN in the name of my Sole Prop Firm.

    Pls guide me on this.

    I am one of the sole proprietar who had to get the Nism certificate which I did in month of July. My age is 65 years and still I got the certificate. The issue is that neither AMFI nor NISM know about their own rules. Firstly NISM gave me wrong certificate. Just because I appeared for the first time in NISM the certificate date issued to me was the date of passing NISM. AMFI rules state that your certificate validity should start from your last expiration date and not the day when i attend NISM. I have dropped multiple complaints but AMFI says to reach out to NISM and NISM says to reach out to AMFI. It has become a joke. Secondly just because one EUIN is already tagged to my ARN they are not giving my sole EUIN where the rules say that I need to get my own EUIN. AMFI should first make process transparent in their and NISM organization before making such rules. It has been a very bad experience.

    Please read the last lines of the article. It clearly states that The power to give exemption is with AMFI ARN Committee. Which means they can do whatever they want and they are not answerable to anyone.

    As a proprietor I did take the NISM exam for renewal and renewed my ARN. There was no provision to renew my EUIN and a query sent to the AMFI unit stated that the EUIN would be automatically renewed as it belongs to the proprietor but the same has not happened so far and all my queries remain unanswered till date. The call center guys have no clue on what's going on I have hit a dead end with my recent transactions going in NIGO with reason EUIN Validity Expired.

    As per new ARN guideline if Sole Proprietor and EUIN both are same persons so no need to renew EUIN

    I HAD THE SAME PROBLEM, AS YOU ARE IN. ON AMFI RENEWAL SITE, THE PROVISION WAS LOCKED TO RENEW EUIN FOR ME, AND WAS SHOWING " NISM CERTIFICATE ALREADY PROCESSED".AFTER RAISING A CMPLAINT WITH CAMS AMFI HELPLINE AND THREATENING THEM TO GO TO THEIR GM, ON THEIR UNRESPONSIVENESS, I AWS PROVIDED WITH THE DIRECT NO. OF THE HEAD OF THE IT TEAM , WHO SOLVED MY QUERY WITHIN 30 MINUTES.
