    Service tax exemption to distributors earning less than Rs.10 lakh from today

    The Budget 2016 has exempted IFAs earning less than Rs.10 lakh from paying service tax by putting it under ‘forward charge’ mechanism.

    With effect from April 1, 2016, distributors earning less than Rs. 10 lakh are exempted from paying service tax.

    After levying Krishi Kalyan Cess, the effective service tax rate goes up to 15% from June 2016.

    The Budget 2016 has shifted the onus of paying service tax on commissions from AMCs to distributors and exempted IFAs earning less than Rs.10 lakh from paying service tax by putting it under ‘forward charge’ mechanism.

    Simply put, distributors having turnover of less than Rs. 10 lakh need not pay service tax. Also, distributors earning more than Rs. 10 lakh can avail the benefit of cenvat credit by setting off the service tax payment against other services availed by them. Distributors stand to gain from this move as they will be allowed to set off service tax against other services. Tax experts say that distributors will have to take service tax number to avail this benefit and use this certificate to set it off against the service tax paid by them to other service providers. This way, distributors will get relief to the extent of service tax paid by them to their vendors.

    The move is expected to benefit a large number of distributors. According to rough industry estimates, only around 1,200 distributors earn more than Rs. 10 lakh annually from mutual funds. There are close to 8,000-10,000 active distributors in India.

    A few Chartered Accountants whom Cafemutual spoke to believe that the service tax exemption will be applicable on total turnover and not only on the commission income from mutual funds. That means, if distributors have commission income from other products like insurance, NCDs and tax-free bonds, this income will be clubbed with MF commission payout for calculation of service tax payout.

    In 2012, the government had put the services of mutual fund agents under the negative list which exempted them from paying service tax. Till 2012, AMCs were deducting service tax and paying it to the government. In Budget 2015, this exemption was withdrawn. So far, fund houses were deducting service tax on commission income of distributors as it was under reverse charge mechanism.

    HAVE ANY IDEA WHOSE INCOME IS MORE THAN 10LAC ............ SERVICE TAX IS APPLICABLE ON THE EXCEEDING AMOUNT OR TOTAL INCOME EARNED?

    Have the same doubt that Abhishek has. If a person earns 9.9 Lakhs he would not have to pay anything. If it crosses 10L say 10.1L will he need to pay 1.5L which puts him in a disadvantageous position compared to the person earning a little lower. The same is applicable to Income crossing 1 crore and some only slightly under a crore as an additional 10% tax is levied for income greater than 1 Crore. In this case the income is taxed at the marginal rate where the person earning more will still have the net income more or similar to the person earning less

    According to forward charge taxation, a person earning above Rs. 10 lakh has to pay service tax only on the additional commission in the first year. For instance, if a distributor has earned Rs.11 lakh in a financial year, he has to pay service tax only on Rs.1 lakh. However, in the subsequent year, the distributor will have to pay on entire commission earned even if it is less than Rs.10 lakh. However, we are awaiting more clarity on this.

    95 % distributors are anyway inactive... hardly matter, if they get any reabte. Charging Service Tax itself is wrong & unethical practice from the so called ethical industry. Agree with Rajesh Sharma... MF Advisory & Insurance Advisory both are similar in nature... but why this is for only MF Advisory.

    Ajay Bhai... Don't worry, SEBI will ensure it that no distributor earns more than Rs 10 Lacs in future, by disclosing your commission on CAS & alongwith all other various measures taken in future as well

    Applying service tax to distributors of having any income level is wrong as they are not availing of any service from the AMCs. In all other cases this tax is borne by the end consumer of the product or service. In other financial products also the service tax is levied on the amount spent or invested by the end investor and not the mediator.

    Why a MF Advisor will pay a Service Tax, wherein a Insurance Advisor not??? Any justification??? Any logic???

    Question from the Industry (AMC/SEBI/AMFI/ Finance Ministry) who give big-big lectures on Tax/Economy..etc.

    In our country in the name of regulation experiments are done and we a part of unorganised sector became the guinea pig in the hands of regulators. In health/medical industry pharma companies and greedy doctors makes money of miseries of poor people, where regulators and govt does nothing. Every body knows the difference between price of Generic medicines and branded ones, still no one does any thing... suspiciously why???

    A small IFA who is earning commission below 9 lac , what he have to do so his service tax may not deduct from his commission cycle by any AMC ?

    MF HOUSE HAD PAID COMMISSION IN MARCH IN ADVANCE. BETWEEN 1-20 TO 24 TH MARCH 2016. WHAT WILL REST DISTRIBUTOR WHOM INCOME LESS THAN 10 LAKH. THEIR SERVICE TAX HAD DEDUCTED @ 14.5%????????????????

    This is very difficult to manage commission recd.less than 10 lacs or greater than 10.00 lacs if the last month income crossed 10.00 lacs distributor stop the business or divert to others
    I suggest to waive service tax upto 10.00 lacs for all IFA and above 10.00 lacs to charge only difference amt.

    Everybody knows why regulator don't take decision on activities of Hospital, Pharma companies....people are in hand in glove. I would like to ask a question to a regulato:

    1. Why don't they cap salary packages of heads of AMCs?
    2. Why SEBI allowed closed ended funds and allowed AMCs to pay high commissions?
    3. AMFI is run by top AMCs...why they are opposing higher charges now whereas they are the one who started paying to distributors in the cover of close-ended funds....why SEBI is not giving any weightage to it.
    4. Is regulator seeing how a distributor runs from pillar to post to convince a customer to invest in mutual fund schemes and earn its living...I think now...they are sitting in AC cabins and enjoying.
    5. Most mis-selling happened in insurance...why they are not making only term plan mandatory and avoid other plans so that money can flow in equities.....

    Dear All respected, just asking one question, my sister is Mutual fund distributor, she recently joined New India Insurance company as Officer after all formalities. The company is 100% govt of india enterprise. Now whether she can continue her MFD practice or any SEBI/AMFI Guidelines will come against her. her ARN is due for renewal in june 2016. Please help. we all are doing this on her name only

    My query is regarding Service Tax Registration. Do all IFAs have to seek Service Tax Registration irrespective of their Commission / Brokerage Income or is it that only IFAs with Income in excess of Rs.10.00 lacs have to seek such registration ? Taking and maintaining Service Tax Registration is quite cumbersome.

    I am representing 4 Towel manufacturing companies situated in. Ta mil Nadu. Wholesale dealers place orders on my Principals. My Principals supply goods directly to dealers and raise bills on dealers. Dealers. make payments to my Principals thru chqs. directly. I assist my Principals in procuring orders and help till getting payments. My Principals give a commission of. 3 % to me. on the nett received amount once in a year. after deducting tds. I AM NOT INVOLVED IN THE TRANDING ACTIVITIES. AT. ALL.
    1. AM I TO. REGISTER WITH. GST. AUTHORITIES ? DO I HAVE TO PAY ANY TAX? PLease advise me in detail. Regards.
