    ‘Rs.40 lakh GST exemption is not applicable for MF distributors’

    Currently, mutual fund distributors earning less than Rs.20 lakh and not having GST registration are exempted from paying GST.

    Can you please clarify if the recent GST exemption on annual income of Rs.40 lakh applicable for MF distributors. If yes, let me know how I can avail this exemption.

    Dear Bikash,

    A few days back, the ministry of finance tweeted about developments in goods and services (GST) tax. However, the series of tweets has created confusion in the MF distribution community about applicability of Rs.40 lakh GST exemption on their business.

    MFDs want to understand whether they qualify to claim GST exemption if they earn up to Rs.40 lakh. In addition, if Maharashtra MFDs earning up to Rs.1.50 crore per annum can opt for lower GST rate of 1% under GST composition scheme.

    However, both these relaxations are not applicable for individuals who work in services sector, which includes MFDs. Also, there is nothing new in this as these relaxations have been around for a while now.

    Currently, the government has exempted distributors irrespective of location earning up to Rs.20 lakh from paying GST offering both intrastate and interstate services. So if you earn commission less than Rs.20 lakh a year, you are exempted from paying GST.

    Ensure that you include commission from other financial products to arrive at your annual income. GST norms include commission income from all financial products such as stock broking and mutual funds to arrive at your annual income.

    On GST Composition Scheme, currently, only a fraction of Maharashtra distributors who do not have business with AMCs beyond the state and earn between Rs.20 lakh and Rs.50 lakh can avail of the benefits of this scheme. The Composition Scheme allows MFDs earning up to Rs.50 lakh to pay GST rate of 6% instead of 18%.

    Dear Nishant....

    As you have stated that these relaxations are not applicable for individual IFA,..what about a private limited Company..who is earning up to 40 lakh in a financial year including all income....

    Can they avail these benefit....kindly clearfiy the same...

    It is not applicable for individuals and companies engaged in services industry which include MF distribution

    Please note that GST exemption limit of Rs 40 lakh turnover ( not income) for goods only. GST exemption rs 20 Lakh income ( not turn over) for services. MFD are covered under servicees so exemption limit is Rs 20 lakh.

    Because you mentioned in your post that this limit of Rs. 40,00,000/- is not applicable for individuals. Does it mean this limit is not applicable to corporates? What is the limit of GST exemption for companies.

    No, It is not applicable for financial services industry

    The exemption limits given in their turnover / income values not on status. It is same for both individual s and corporates.

    Please explain any AMC out of Maharashtra..? as said "GST Composition Scheme," currently, only a fraction of Maharashtra distributors who do not have business with AMCs beyond the state and earn between Rs.20 lakh and Rs.50 lakh can avail of the benefits of this scheme @6% p.a.

    Hi Nishant, could you please clarify the following doubts. 1. I am residing in Pondicherry and doing business is here and the total income is 42,00,000/-(LIC + Star Health + Mutual funds) I shall get the composition tax payer?. 2. My mutual fund income is 28,00,000/-, whether I should pay the GST? ( since service tax regime, i am paying the tax on mutual fund income). thanks in advance. K. Kannan

    No, composition Scheme is not applicable to you as you are doing interstate business (i.e. dealing with maharastra AMCs). Yes you need to pay GST on all your Income , if the Star Health , LIC is already charging GST on your commission then you can take input benefit for the same.

    Can you Clarify- if Some one is Earning from other source -( Individual Pan int other Business ) and also Earning Brokerage from MF- If IT goes beyond 20 Lakh - What We have to Do- What is the Taxation

    Your other sources of income is from services or goods, 1st exemption limit is 20 lakh. So you are covered under taxation after income crosses 20 Lakh.

    Dear Nishant,

    It is regarding the GST of 11 percent deducted from the agent commission (rest 7 percent is to be absorbed by the company as they say) , Can an insurance adviser take GST input if he is doing some other business (goods trade) on same PAN no. (proprietor). Please advice if there is some other option to claim/take input of the deducted amount.

    Dear Nishant,

    If my income across all products below 20 lakhs.but we have obtained GST number. Therefore, Do we need to pay GST even though income is overall income below 20 lakhs ?

    I have not updated GST number with MF because my revenue is less than 20 lakhs.

    I am a Sub-Broker with a Mutual Fund Broker and he deducts GST from my commission payout. My total commission income from financial services is less than Rs.10 lakhs. Am i eligible for commission without deduction from Broker or is the broker right in deducting 15% GST from my share of Commissions ??

    MFDs are getting commissions on distribution of MFs. Do they receive GST from fund houses on commission they generate ??
    Ex. - If I have generated 1000 Rs. commission, Can I get 18% GST on above 1000 Rs ??
