    No upfront commission on SIPs registered before Oct 22: SEBI

    However, SEBI has asked fund houses to pay withheld upfront commission to distributors within 3 months.

    In a letter sent to AMFI, SEBI has said that fund houses cannot pay upfront commission on SIPs registered before October 22.

    Earlier, AMFI has sought clarification on the circular issued on October 22, 2018 on the issue of payment of upfront commission on SIPs registered before October 22.

    On grandfathering of upfront commission on future instalment of SIPs registered prior to October 22, 2018, SEBI said, “The request of AMFI for exemption for upfront commission for all SIPs registered prior to SEBI circular dated October 22, 2018 is not acceded to.”

    However, SEBI has asked fund houses to pay withheld commission to distributors within three months. AMCs have withheld commission including upfront commission for sales recorded before October 22, 2018 due to claw back, ARN renewal pending and so on.

    SEBI said, “Regarding payment of withheld commission, including upfront commission for sales pertaining to the period prior to October 22, 2018, the request of AMFI is acceded to. AMCs may be advised by AMFI to make all the withheld payments within a period of 3 months from the date of this letter, subject to fulfilment of all the requirements specified.”

    On interpretation of certain selling and distribution payments that include sending distributors on skill development programs and running loyalty programs for them, SEBI said that the market regulator has adequately dealt with these issues. “The issue raised by AMFI has been adequately dealt with in the circular and it is mandatory for the AMCs to follow the provisions of the circular,” said SEBI.

    The new SEBI rule says that training sessions and programs conducted for distributors should be continued but not misused for providing any reward or non-cash incentive to them.

    Sir I can’t understand the logic of amc for rest all items they say we can’t overrule sebi now they all unite and tell we can’t pay for sip logged b4 22 October 18, what r they going to do for sip logged b4 2009 with entry load I hv got many sip running even after the no load, direct , kyc, FATCA and now nach some example dsp ssip, reliance sip insurance initially they 360 times life cover according to me like this there are so many sips running since last so many years

    It is the high time for distributors and their association to move to Finance ministry or FMC and discuss this matter and find out a solution. SEBI is not a dictator to introduce rules as per it's whims and likings. In case no solution comes distributors should move to Supreme court to get right judgement

    withheld payments to be made within 3 months if requirements are fulfilled? What is the meaning of this - if requirements are fulfilled . Of God! this is the limit. All the IFAs should leave enmass now that nothing is left to destroy them. Come April 2019, further reduction will be there. Nothing is left in this business. AMFI should feel happy now . Let the AMFI and SEBI celebrate the total extinction of IFAs . Now let AMCs take care of servicing of clients directly. Even now if IFAs don't react , they have to take a lesson from our honourable Prime Minister . We are living in a democratic set up . We should blame the AMFI only for not presenting the real picture to SEBI and Finance Ministry. Sickening is not the word.

    I knew it was an eyewash. AMCs are now suffering from low business so now they are trying to show to distributors that they are on their side but we have known all along that you are against us and you want to keep all the money to yourself and of course with the help of SEBI.

    Amfi does not represent distributers so they do not think about us.small and new distributers will turn to other products.

    Nobody is deshbhagat, even modiji, job destroyer are never with country. We pay GST intime, we are deshbhagat rather than so called self style deshbhagat.

    Hi,
    Expert opinion required.
    My ARN expiry was 2nd March 2018 before which i completed CPE training and got certificate which valid till 2nd march 2021 however, by mistake ARN was not renewed but CPE was completed hence my trail commission is pending since last 1 year now 3 days back i have paid 1770/- for online ARN renewal and now its updated on AMFI website.

    AMC are saying you will not get your trail commission, please suggest any wayout for the same cafemutual,,, expecting help M - 9145455293.
